Governor Carcieri Questions Legality of Casino Question on Ballot

The Narragansett Indian Tribe's plan to build a casino may be facing another hurdle as Gov. Don Carcieri asked the state Supreme Court to review a proposed constitutional amendment allowing the tribe to run casino games on Monday.

The amendment that would permit the Narragansett Indians and partner casino giant Harrah's Entertainment to operate a West Warwick casino as adopted by the General Assembly. Before it becomes law, Rhode Island voters must first approve the amendment on the fall ballot.

"An advisory opinion from the Supreme Court will conclusively lay to rest any question about the constitutionality of this casino proposal," Carcieri said.

Democrat Attorney General Patrick Lynch has likewise echoed the request for court review.

"The people have a right to decide," said Carcieri. The governor has been a longtime casino opponent.

"But it makes no sense to ask them to vote on a question that might be struck down after the vote takes place," he added.

The constitution of Rhode Island prohibits the operation of privately run casinos as it requires state authorities to operate all lotteries, including casino games.

According to Tribal First Councilman Randy Noka, it was another desperate ploy by the governor to take the decision from the hands of the public.
